These Terms of Service (“Terms”) govern your use of our website, online store, products, and services (collectively, the “Services”).

Bound by Heritage is the trading name of Tiarnan O'Neill, a sole trader based in Northern Ireland, United Kingdom.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

If you are a consumer resident in the United Kingdom or the Republic of Ireland, these Terms work alongside your statutory rights under the laws of your country of residence. Nothing in these Terms is intended to limit those rights.


SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of majority in your place of residence, or that you have obtained permission from a parent or guardian to use the Services.

When creating an account or placing an order, you agree that all information provided is accurate, complete, and up to date. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

We reserve the right to refuse service, terminate accounts, or cancel orders where we reasonably believe information provided is inaccurate, misleading, or fraudulent, or where you have otherwise breached these Terms.


SECTION 2 – OUR PRODUCTS

All Bound by Heritage products are made to order using print-on-demand production. As a result:

  • Colour, placement, or appearance may vary slightly from digital mockups.

  • Product descriptions and designs may be updated, changed, or discontinued without notice.

  • Quantities may be limited at our discretion.

  • We do not guarantee that your device’s display will accurately represent the final product.

Because products are printed to order, our Refund & Returns Policy sets out specific rules for returns and exchanges, particularly in relation to change-of-mind requests.


SECTION 3 – ORDERS

By placing an order, you make an offer to purchase the selected products from us. We reserve the right to accept or decline any order for any reason, including suspected fraud or breach of these Terms.

An order is only confirmed when:

  1. Payment has been successfully processed; and

  2. You receive an order confirmation from us.

Due to the made-to-order nature of our products:

  • We may not be able to cancel orders once production has begun.

  • Any cancellation options and timelines will be set out in our Refund & Returns Policy and/or on the checkout page.

All returns, replacements and exchanges are handled according to our Refund & Returns Policy, which forms part of these Terms.

You confirm that purchases are for personal use and not for resale, unless we have agreed otherwise in writing.


SECTION 4 – PRICES AND BILLING

Prices for our products are as shown on our website and may change at any time. The price you pay will be the price displayed at checkout at the time you place your order.

Unless stated otherwise, prices exclude:

  • Shipping charges

  • Taxes (such as VAT)

  • Duties or other import charges (if applicable)

Any additional charges (for example, shipping or taxes) will be shown at checkout before you complete your order.

You agree to:

  • Provide accurate, current, and complete billing and contact information; and

  • Keep your payment details up to date so that we can complete transactions.

If your payment method cannot be verified, is invalid, or is otherwise not acceptable, we may suspend or cancel your order.


SECTION 5 – SHIPPING AND DELIVERY

We are based in Northern Ireland and currently ship orders to:

  • The United Kingdom (including Northern Ireland)

  • The Republic of Ireland

Orders are shipped to the delivery address you provide at checkout. Please ensure your address (including postcode/Eircode) is accurate and complete.

Delivery times are estimates only and are not guaranteed. Once an order has been handed to the courier, the risk of loss or damage passes to you, without prejudice to any rights you may have if goods are lost or damaged in transit.

We are not responsible for delays caused by:

  • Carriers or couriers

  • Customs checks (where applicable)

  • Weather or other events outside our control

  • Incorrect or incomplete delivery information provided by you

SECTION 6 – INTELLECTUAL PROPERTY

All content on our website—including logos, designs, artwork, images, graphics, and text—is the intellectual property of Bound by Heritage or our licensors, and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, reproduce, modify, distribute, or publicly display any content from our Services; or

  • Use any of our intellectual property (including brand name, logos, designs, or artwork) without our prior written permission.


SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools or features that we do not monitor or control.

You acknowledge that:

  • These tools are provided “as is” and “as available”; and

  • We have no liability arising from or relating to your use of such tools.

Any new features or tools added to the Services in future will also be subject to these Terms.


SECTION 8 – THIRD-PARTY LINKS

Our Services may include links to third-party websites or resources that are not owned or controlled by us.

We are not responsible for:

  • Examining or evaluating the accuracy, content, or security of third-party sites; or

  • Any loss or damage that may arise from your use of them.

Any concerns regarding third-party products, services, or websites should be directed to the relevant provider.


SECTION 9 – RELATIONSHIP WITH SHOPIFY

Bound by Heritage is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Bound by Heritage.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bound by Heritage, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bound by Heritage.


SECTION 10 – PRIVACY POLICY

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and process your personal information. Shopify also processes certain information as part of hosting and operating the store.

Any feedback, ideas, reviews, suggestions, or other materials submitted to us (collectively, “Feedback”) may be used by us for any lawful purpose, including marketing and service improvement, without obligation to compensate you.

  • You have the right to provide the Feedback; and

  • It does not infringe or violate the rights of any third party.


SECTION 12 – ERRORS AND INACCURACIES

We may occasionally update information on the Services to correct typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, and availability.

We reserve the right to:

  • Correct any errors or omissions;

  • Change or update information; or

  • Cancel orders affected by inaccurate information,

at any time and without prior notice, including after you have submitted your order, where permitted by law.

You may not use our Services:

  • For any unlawful, fraudulent, or harmful purpose

  • To violate any copyright, trademark, or other intellectual property rights

  • To harass, abuse, insult, harm, defame, or intimidate others

We may terminate or suspend your access to the Services, in whole or in part, at any time and without notice, where we reasonably believe that:

  • You have breached these Terms; or

  • Your use poses a risk to us, our systems, or other users.

On termination:

  • Your right to use the Services will cease immediately; and

  • Any obligations or rights that by their nature should reasonably survive termination—such as intellectual property, limitations of liability, and indemnities—will continue to apply.


SECTION 15 – DISCLAIMER OF WARRANTIES

Our Services and products are provided on an “as is” and “as available” basis, without any warranties or representations of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free; or

  • Any defects will be corrected.

Some jurisdictions, including in the UK and EU, do not allow certain limitations on implied warranties. In those cases, some of the above limitations may not apply to you, and your statutory rights remain unaffected.


SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by UK law, Bound by Heritage and its proprietor, employees, and agents shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages; or

  • Loss of profits, revenue, data, or goodwill,

arising from or related to your use of the Services or products purchased through the Services.

Nothing in these Terms shall:

  • Exclude or limit liability for death or personal injury caused by negligence;

  • Exclude or limit liability for fraud or fraudulent misrepresentation; or

  • Exclude any liability that cannot be excluded under applicable law.

If you are a consumer resident in the Republic of Ireland or elsewhere in the EU, the limitations in this section apply only to the extent permitted by the laws of your country of residence.


SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Bound by Heritage, and its proprietor, employees, and agents, from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms; or

  • Your misuse of the Services or violation of any law or third-party right.


SECTION 18 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severed from these Terms and will not affect the validity and enforceability of the remaining provisions.


SECTION 19 – ENTIRE AGREEMENT

These Terms, together with our other policies (including our Refund & Returns Policy, Shipping Policy, and Privacy Policy), constitute the entire agreement between you and Bound by Heritage regarding your use of the Services and purchase of products from us.


SECTION 20 – ASSIGNMENT

You may not assign, transfer, or subcontract any of your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms at any time, provided that this does not reduce your statutory rights.


SECTION 21 – GOVERNING LAW

These Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Northern Ireland and the United Kingdom.

You agree that the courts of Northern Ireland shall have exclusive jurisdiction, without prejudice to any mandatory rights you may have as a consumer to bring a claim in the courts of your country of residence (for example, the Republic of Ireland).

Headings are for convenience only and do not affect the interpretation or meaning of these Terms.


SECTION 23 – CHANGES TO TERMS

We reserve the right to update, modify, or replace any part of these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page.

Your continued use of the Services after any changes have been posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Services.
